The HMVH Corporation BBS - System Rules and Disclaimer: 15-06-1997 ====================================================== ---------- Introduction: ------------ I, Herby Hönigsperger, owner and system operator (henceforth referred to as the SysOp) of the HMVH Corporation Bulletin Board System (henceforth referred to as the BBS) hereby exercise my right to enforce and apply the rules and regulations outlined in the paragraphs that follow as I see fit. By continuing to make use of this service, you (the user) indicate your acceptance of this agreement and all rules and regulations laid down by the SysOp. You further acknowledge that you have read and understood these rules and agree to be bound by their terms and conditions. If you do not agree with these terms, you should answer "N" (No) when prompted for confirmation of acceptance of said terms and log off the system immediately. A shortened copy of these rules is available for reading by validated users. Press [Enter] for more... Rules of this BBS: ----------------- All equipment utilised to offer this service has been supplied by the SysOp's own financial and technical resources. It therefore stands to good reason that the rules laid down are simply for the SysOp's own protection. No fees (other than a "donation") are charged for the use of this BBS. For full access to all file- and message groups you are, however, required to mail us a copy of your Identity Document or Passport. Under no circumstances will users under the age of 18 years be permitted on this BBS. This BBS has been established purely for the experiential benefit of the SysOp and may cease to exist or be modified in any way and at any time at the SysOp's discretion although all reasonable efforts will be made to keep this system online for as long as this planet continues to rotate. Any users, regardless of race, colour, creed, religion or sexual persuasion ABOVE the age of 18 years are therefore welcome to use this system when and if they please. The SysOp does, however, reserve the exclusive right to lock out or barr any user whom he deems unwelcome or undesirable, based solely on his understanding and judgement of good manners and protocol that should be applied to any service of this kind, and on any blatant ignorance of these rules and regulations by that user. Various security levels and flags have been created in an effort to grade and group all users of this BBS. All new users (like you) are initially allocated a Security Level of 1. Only by following the instructions laid down (such as filling in the New User Questionnaire and reading this System Rules and Disclaimer text file) will any user's security level increase, thereby gaining access to otherwise prohibited areas (such as certain file- or message areas, doors, etc.), functions or services of this BBS. The decision on any user's security level and its associated privileges is made, as unbiased as possible, exclusively by the SysOp. For a more detailed explanation on security levels read the "About Security Levels" bulletin). Press [Enter] for more... Disclaimer: ---------- The HMVH Corporation BBS also features several message areas where users may leave messages to one another or place advertisements to all other users if they so desire. Messages may be marked as private or public, with only the SysOp having rights to view or edit ANY messages on the BBS. To this effect, users are warned against using any abusive or offensive language in message areas that are not designed for this purpose or may be read by other users. These regulations apply to the local message base only, the rules of other networks may differ from those above. The SysOp therefore assumes no responsibility whatsoever for the content, quality, accuracy or language used in or of any messages placed on the BBS, and promises only to warn, prevent or delete users who are not following a sense of reasonable manners. A wide choice and selection of files exists on this BBS. Depending on their security, users may download a certain amount of files that they have access to. Furthermore, users are encouraged to upload other files to the BBS in Press [Enter] for more... return (the SysOp stresses that this bulletin board has not been established for the purpose of acquiring software). The SysOp, therefore, does not warrant, nor can guarantee, that the files or data contained therein are accurate or suitable for a specific purpose or intention. Under no circum- stances will the SysOp, or any other persons associated with this BBS, living or dead, be liable to you or any other parties for any damage, physical, psychological or otherwise, lost profits, loss of data or finance, either direct or consequential arising out of the use, or inability to use, any information or software that has been obtained from the HMVH Corporation BBS through any means. Virus detection software has been installed on this BBS. Should any user, either willfully or not, upload a virus to the BBS, his security will be downgraded to such a level that said user is prevented from performing any further uploads. The user's security level will be restored to its original value only once the SysOp can positively be assured that no further uploads of virally infected software take place. Should similar behaviour by the same user be encountered, that user shall be barred from this BBS. Although all reasonable efforts are made to ensure that all software or files available for download are free of virii or trojan horse programs, the SysOp will, in no event, be held responsible for any damage these programs Press [Enter] for more... may or may not cause. Conversely, should any file/s that a user has obtained from this BBS be infected by a computer virus or other malicious software, it becomes the responsibility of that user to notify the SysOp immediately so that the infected file/s can be removed as soon as possible in order to prevent the possibility of distribution to other users. Similarly, the SysOp assumes no responsibility, direct or implied, for the presence of commercial or copyrighted software (other than Public Domain, Freeware or Shareware programs) that may have been uploaded by a user of this bulletin board. Should this be the case, the SysOp's only duty in this regard is to remove such a program immediately and warn the uploader accordingly. Users, therefore, assume all responsibilities to determine whether or not the up/downloaded software is in the Public Domain or a Shareware program. If, however, a user continues to upload such "illegal" software, legal steps can, and will, be taken against that person. Additionally, that user will be barred from further use of this BBS. The upload of any program or data furthermore grants the SysOp the right to modify, edit or repackage the data, providing that any rights originally contained within an archive (ZIP being the preferred archive) remain intact.
